General

Kolibri Coffee V.O.F., registered in the Netherlands, operates this website and related services. Our registered address, Chamber of Commerce (KvK) number, VAT number, and contact details are available on our website and may be used for all correspondence regarding orders, services, and these Terms.

Applicability

These Terms and Conditions apply to all offers, orders, agreements, and use of the Kolibri Coffee website. By placing an order or using our website, you agree to be bound by these Terms. Any deviation is valid only if agreed upon in writing.

Offers and Product Information

All offers are non-binding and subject to availability. Product descriptions, images, and specifications are provided with care but may differ slightly from the actual product. Kolibri Coffee reserves the right to change, limit, or discontinue products at any time.

Order

An agreement is concluded once you receive an order confirmation by email. Kolibri Coffee reserves the right to refuse or cancel orders in cases of incorrect information, pricing errors, stock limitations, suspected misuse, or force majeure.

If there is any problem with the delivery of your order, we will contact you immediately. You will have the right to change or cancel your order, but please note the following:

  • Change of order must be notified before order is packed.
  • Cancellation must be notified before order is shipped or after 14 days of delivery for goods except for coffee. (See “Withdrawal”)

Prices & Fees

All prices are stated in euros (EUR) and include VAT (BTW), unless explicitly stated otherwise.
Shipping costs and any additional charges are displayed during checkout. Obvious pricing or typographical errors do not bind Kolibri Coffee. Special offers and promotions marketed on the website apply while the stock lasts unless other conditions are informed in relation to the offer.

  • The prices of our products are subject to change without prior notice.
  • We will not be liable to you or to any third party for any modification, price change, suspension or interruption of our service.

Payment

Kolibri Coffee uses WooCoomerce, PayPal and Mollie B.V.  as intermediaries for handling payments.

You can pay with Mastercard, VISA, Paypal, Ideal (available for maestro customers) and SOFORT – Europe (Duitsland, Oostenrijk, Nederland, Zwitserland, Italië, Spanje, België en Polen). The card is charged in connection with orders. Mollie handles the card information and is authorized with PCI DSS certification to ensure that the customer’s card information is transferred and stored securely in encrypted form.

Fulfillment

The agreement is fulfilled by Kolibri Coffee once the ordered products have been delivered in full to the customer. Fulfillment begins when the customer receives an order confirmation by email. The customer fulfills their obligations under the agreement once full payment has been made and the ordered products have been received as agreed.

Delivery

Orders are delivered to the address provided by the customer using our logistics partners (DPD, DHL, or PostNL). Shipments are made on business days only (Monday to Friday, excluding Dutch public holidays).

Shipping costs are shown during checkout and are borne by the customer, unless agreed otherwise.

Kolibri Coffee may wait to start delivery until full payment has been received. Any delivery or transit times provided are indicative only and do not entitle the customer to cancellation or compensation, unless expressly agreed in writing. If no delivery time has been specified, Kolibri Coffee will deliver the order without undue delay and no later than 30 days after the agreement is concluded.

Withdrawal

Consumers have the right to withdraw from an online purchase within 14 days of receiving the product, in accordance with EU consumer law. No reason is required.

To exercise the right of withdrawal, the customer must notify Kolibri Coffee (via the contact form or by email at [email protected]) within the withdrawal period and return the products within 14 days after delivery. Return shipping costs are borne by the customer.

The right of withdrawal does not apply to perishable goods, including coffee. The statutory withdrawal period also does not apply to business-to-business (B2B) purchases, unless otherwise agreed in writing.

Refund

Refunds are issued only in accordance with the applicable withdrawal, return, or warranty provisions. Once a refund is approved, Kolibri Coffee will process the refund using the same payment method used for the original purchase, unless otherwise agreed. Refunds will be made no later than the statutory period after receipt of the returned products or proof of return. Shipping costs are refunded only where required by law. Kolibri Coffee reserves the right to deduct any loss in value resulting from unnecessary handling of the products.

Returns

Returned Products must be unused, undamaged, and in their original packaging. Return shipping costs are borne by the customer unless agreed otherwise. Kolibri Coffee reserves the right to refuse returns that do not meet these conditions.

When returning products or materials to Kolibri Coffee, all products must be unused, undamaged, and in their original packaging with all labels / tags and cannot exceed 14 days after delivery. Coffee items are non-refundable due to the nature of the product. If you are not satisfied with the quality of the product, please contact us directly.

Warranty

Kolibri Coffee guarantees that all products comply with the agreement and meet reasonable standards of quality, usability, and safety in accordance with Dutch law. Consumers are entitled to the statutory warranty, meaning that products must conform to what the customer may reasonably expect based on the product description.

If a product is defective or does not conform to the agreement, the customer must notify Kolibri Coffee within a reasonable time after discovering the defect. Kolibri Coffee will, at its discretion and in accordance with applicable law, provide a suitable solution such as repair, replacement, or refund.

Food disclaimer: Due to the perishable nature of food products, including coffee, minor variations in taste, aroma, color, or freshness may occur and do not constitute a defect. Proper storage and handling instructions must be followed by the customer.

The statutory warranty applies only to consumer purchases. For business-to-business (B2B) transactions, warranty terms apply only if expressly agreed in writing.

Intellectual Property

All intellectual property rights relating to the Kolibri Coffee website and its content, including but not limited to text, images, logos, branding, designs, and software, are the exclusive property of Kolibri Coffee or its licensors. No part of the website or its content may be copied, reproduced, distributed, or otherwise used without prior written permission, except as permitted by mandatory law.

Personal Data & Privacy

Kolibri Coffee processes personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR). Personal data are used only for purposes related to order processing, customer service, and legal obligations. Force Majeure

Kolibri Coffee shall not be liable for any failure or delay in the performance of its obligations if such failure or delay is due to circumstances beyond its reasonable control, including but not limited to strikes, transport disruptions, natural disasters, extreme weather conditions, insurrection, riots, labor disputes, sabotage, technical failures, pandemics, or government measures. In such cases, Kolibri Coffee is entitled to suspend or terminate the agreement without compensation.

Liability

Kolibri Coffee’s liability is limited to the amount paid by the customer for the relevant order, unless liability cannot be excluded or limited under applicable law. Kolibri Coffee is not liable for indirect, incidental, or consequential damages, including loss of profit or business interruption. Nothing in these Terms limits Kolibri Coffee’s liability for intent, gross negligence, or statutory consumer rights.

Amendments

Kolibri Coffee reserves the right to amend these Terms and Conditions at any time. Any amendments will be published on the website and will apply from the date of publication. Continued use of the website or placement of orders after such amendments constitutes acceptance of the updated Terms.

Kolibri Coffee also reserves the right to cancel or terminate an agreement if the customer has acted in bad faith or if the agreement was concluded on the basis of incorrect or misleading information that the customer could reasonably have been expected to notice, including evident inaccuracies on the website.

Furthermore, Kolibri Coffee reserves the right to modify the content of the website at any time without prior notice, including but not limited to products, prices, availability, blog posts, and promotions.

Kolibri Coffee shall be released from its obligations under the agreement if performance is prevented by circumstances beyond its reasonable control or by events not attributable to Kolibri Coffee, insofar as permitted by mandatory law.
